Taggart Investments agrees to Area 11 pre-conditions

Taggart Investments has agreed in writing (see letter below) to support and agree with 16 pre-conditions that were outlined in the CCCA presentation made on May 12, 2009 at the Planning Committee.

These pre-conditions were posted on our website earlier , and are reproduced here:

  1. Complete the Cardinal Creek Sub-watershed study and environmental management plan before allowing the consideration of the Community Design Plan. This will ensure that the proper environmental baseline studies are completed by independent City staff.  Ensure this work is completed by September 30, 2009 as it is a year and one-half late.
  2. Secure Tamarack (Queen Street Corp) support for the four-laning of Hwy 17 from Trim Road to the entrance of the mixed use commercial-Cardinal Village Sports Complex to be located adjacent to Hwy 17 (11E). Ensure a safe and secure traffic light and merge lane at this location.
  3. Secure Tamarack (Queen Street Corp) support and plans for the four-laning of Montreal Road to Trim Road. 
  4. Secure City Council approval and funding to accelerate the development of the Trim Road re-alignment, the four-laning of Trim Road to Innes Road and construction of a clover leaf at Trim Road and Hwy 174 to accommodate increased traffic demands from the new Cite Collegial, new commercial-industrial expansion and urban growth.
  5. Secure Tamarack (Queen Street Corp) written concurrence to ensure all treed areas adjacent and backing onto Ted Kelly Lane are removed from their OPA 11 submission.
  6. Secure Tamarack (Queen Street Corp) written concurrence to plant a minimum of $250,000 value of trees in this new OPA area and ensure that a portion are butternut trees, an endangered species in the Province of Ontario and a tree common to this area.
  7. Secure City Council approval NOW on a tree conservation by-law that places strict controls on the cutting of trees within one kilometre of the urban boundary area. This will assist in preventing the Kanata and Cumberland tree clear cutting experiences from happening in the future. It will also demonstrate the City of Ottawa's environmental stewardship leadership.
  8. Obtain written agreement from Tamarack (Queen Street Corp) for the transfer of 60 acres of valuable wood lots, in close proximity to Cardinal Creek and the Ottawa River, to the City of Ottawa for a dollar.
  9. Obtain Tamarack (Queen Street Corp) written approval to make the results of all of their OPA 11 soil tests public to ensure no future development is going to take place on unstable soils.
  10. Secure City Council approval for a special protection zone (e.g. no construction of any kind) on lands surrounding the Cardinal Creek Karst, the 8th longest karst in Ontario and soon to be recognized as a provincially significant earth sciences ANSI.
  11. Secure Tamarack (Queen Street Corp) written concurrence to a stone dust pathway connection to Watters Road East and Petrie Island as part of its proposed pathway system.
  12. Secure Tamarack (Queen Street Corp) written consent to special measures to maintain and protect the wildlife, aquatic life and natural environmental area of Cardinal Creek.
  13. Secure a funding commitment by Tamarack (Queen Street Corp) to contribute a minimum of $250,000 for the construction of a new sports complex in the vicinity of Cardinal Village to reduce the obesity concerns of a growing and young community, similar to the approach initiated by Mattami Homes Ltd.
  14. Ensure some provision for adequate public transit is built into the requirements of OPA 11 to demonstrate Tamarack (Queen Street Corp's) commitment to environmental stewardship.
  15. Secure Tamarack (Queen Street Corp) written concurrence to quarterly on-going public consultations on all key planning and development matters related to OPA 11 over the next five years.
  16. As the CCCA noted in our submission of March 31, 2009, we are supportive of reasonable growth in OPA 11.  In our view, reasonable growth would put a 10-year moratorium on all OPA 11 growth south of Montreal Road until such time as the lands (11A, 11B and 11E) north of Montreal Road are fully built out.  We would therefore request that you not permit amendment #69 (Technical OPA Amendment) to apply to this OPA in the future. We would respectfully request that a full Council vote be required in the future to bring this 10-year moratorium area into the build zone.

Area 11: Pre-conditions to development

The CCCA has presented a written submission to the Joint Rural Affairs and Planning and Environment Committee at the City of Ottawa today. The submission was prepared by Sean Crossan, CCCA Director of Planning and Development and Past President of the CCCA. The submission is reproduced below.

Dear Members of the Joint Rural and Planning Environment Committee,

I am here today in my capacity as Director, Planning and Development and Past President of the Cardinal Creek Community Association (CCCA). The CCCA represents approximately 10,000 residents located east and west of Trim Road.  Our community borders OPA 11 therefore we are directly impacted by this proposed Official Plan Amendment.

Let me start by noting our concern over the lack of transparency and responsiveness of City staff on planning and infrastructure matters related to this city-wide OPA process. In our view, it is a disgrace that no summary analytical tables were made available to the public for all of City of Ottawa OPA areas - this has limited public debate and informed decision-making. The CCCA is still awaiting responses to enquiries, sent about 10 days ago, concerning city-wide OPA issues. I will submit the letters to the Clerk of this Committee so that they are on the public record, as well as to ensure that the CCCA receives prompt and complete responses.

As you know, we are currently in a time of major economic downturn thus the CCCA believes the size of OPA 11 needs to be compatible with the projected economic growth for the City of Ottawa.  The TD Bank, under the leadership of Mr. Don Drummond, is forecasting a decline in growth until 2011 and then moderate to gradual growth until 2013. This moderate growth is forecast to take place over a 3 year period. In the short-term, this slower growth period would allow City Council, City staff and Tamarack (Queen Street Corporation) to meet a number of pre-conditions for approval. These pre-conditions are as follows:

The CCCA is in support of the 167 acre OPA area north of Montreal Road (11a, 11b and 11e) as long as our 16 preconditions are met. We realize that reasonable and controlled growth is required during a time of economic instability.  However, the CCCA also understands the importance of creating economic growth and jobs in the Ottawa area. We feel the Tamarack (Queen Street Corp) plan, if it meets our 16 pre-conditions, will have taken sufficient steps to address our concerns and gain our support moving forward.  We look forward to your support on our preconditions and a reasonable Tamarack (Queen Street) OPA 11 proposal.

Area 11 Meetings

A message from Rob Jellett's office:

The Joint meeting of the City's Planning and Rural Affairs committees will begin at 9:30am Monday May 11.  City staff will present the official plan to the committee and there will be questions from councillors.  For those who wish to view all of the documentation it is available on the City website at the following link: http://www.ottawa.ca/cgi-bin/docs.pl?Elist=13113〈=en.

Two days, Tuesday May 11 and Thursday May 13 have been set aside for delegations.

City Stream Watch Report 2008

We are putting on our website a copy of the 2008 City Stream Watch Annual Report by the Rideau Valley Conservation Authority. Starting on page 34, the document specifically reports on the Cardinal Creek area scientific observations made during the year 2008. This includes a description of natural habitats, land use, species at risk, human alterations, the karst, vegetation, pollution, fish sampling, bank stability, all nicely illustrated by data and pictures.

Some excerpts from the Report:

A total of 7.4 kilometres of Cardinal Creek was sampled during the 2008 season by the Rideau Valley Conservation Authority.

The headwaters of Cardinal Creek are primarily surrounded by agriculture, with a number of municipal drains that empty into the stream. Further downstream, the area becomes more residential, and there are also some significant natural areas.

Housing development pressures have increased over recent years; more subdivisions are being built adjacent to the creek, and many of those have been built within the last ten years.

Species at risk in the area are Butternut (Juglans cinerea), Blanding's Turtle (Emydoidea blandingii) and Northern Map Turtle (Graptemys geographica). Ninety-two bird species have been found there, and some of those species are ependent on habitat that has been declining, including birds that require forest interior (>200m) and grassland birds. The mouth of Cardinal Creek feeds into a wetland that extends to Petrie Island and intersects an area of significant nesting habitat for amphibians and reptiles.

A karst feature on Watter's Road is being considered by the Ontario Ministry of Natural Resources OMNR) as an Area of Scientific Natural Interest.

New website on Interprovincial Bridge

The CCCA would like to inform its residents of the creation of the "Common Sense Crossings" website. This website is to help the citizens of the National Capital Region understand what is at stake with the two proposed Greenbelt bridge options for both sides of the Ottawa River.

On this website you will find information as to why building a bridge over the greenbelt does not solve the interprovincial traffic problem. It explains:

  • why truck traffic will not benefit from crossing the river by going across the greenbelt;
  • how the proposed greenbelt solution will worsen the traffic problems at the 417/174 split;
  • how a greenbelt option will cost more;
  • the negative impacts on the community and residents, including impacts to Cardinal Creek residents who commute through the 174 for work;
  • and shows that the "Canotek" option is a red herring.
